 What Is Responsible Government?

How can constituents be assured of instituted checks and balances in government when those privileged to govern have abandoned their post? Admittedly, the last few months have not been easy for anyone. Still, if Canada continues down the current slippery slope, we all might wake up one day to a country that we will neither know nor cherish. This is my concern. In particular, My concern is that we, as a collective, have allowed Covid-19 to sidetrack a much-needed conversation regarding the erosion of our fundamental rights and freedoms in Canada. These rights and freedoms — entrenched in the Charter under the supremacy of God and rule of law, coupled with the 1867 British North America Act (BNA) — are repeatedly being pushed aside by a proliferation of “untested” laws enacted with minimal (if any?) parliamentary/legislative oversight.

Historically, we should have learned that when the accumulation of powers — the legislative, executive and judiciary — are combined in the same hands, whether of one, a few, or many; hereditary, self-appointed or elective, the consequence may be justly pronounced as the very definition of tyranny. (J. Story, 379)

Will tyranny and one-man dictatorship be the eventual outcome; this is how it appears for all of us standing back and watching the PM arbitrarily violate every many of the rights and freedoms we have.? Most certainly, the usurpation and uniting of authoritarian power under one man has been enhanced under Trudeau — to the point that the conundrum now for your constituents is fear whether our liberty and freedoms will even be recognized.

Certainly, the ability of Canadian citizens to secure a passport as a prime example (the Charter guaranteeing the right of citizens to freely leave, remain in, and re-enter Canada) has been ironically replaced by what is in essence contradictory house arrest and stay at home orders. The voices of social justice warriors attempting to shut down dissenting opinions (previously accepted and welcomed as free speech), freedom of thought, belief, opinion and expression, freedom of peaceful assembly; and association, and freedom of conscience and religion are sadly, not being discouraged or condemned by those in governing positions.

And, although everyone has the right to life, liberty and security of the person, and similarly, the right not to be deprived thereof — except in accordance with the principles of fundamental justice — we are witnessing arbitrary decision-making without any factual basis or legislative oversight, temporary measures established without a defined end date, and contrary, contradictory messaging established by unelected (and presumably, equally unaccountable government opportunists.

These new players are not elected by constituents. Their opinions and subsequent actions have not been properly vetted and voted upon by the electorate. More importantly, none of these previously unknown by the populace appointees has sworn allegiance to the Sovereign,; the institutions the Queen represents,; or the concept of democracy. The latter, in and of itself, should be disconcerting to every Canadian.

And now, the “temporary” measures continue whilst governing authorities in provincial jurisdictions across Atlantic Canada violate our Charter rights (in essence, establish border barriers) preventing citizens of Canada from moving and taking up residence and/or pursuing a livelihood in another province. It appears that the illegal blockades that prevented suppliers from shipping necessities across the country earlier this year are now manned by policing authorities at provincial borders demanding documentation before entry— even though everyone has the inherent right not to be arbitrarily detained.

Again, the Charter declares that we the people of Canada have the right to be secure against unreasonable search or seizure — from all levels of government and its appointed agents. Therefore, when the Charter states that every individual is equal before and under the law, and has the right to equal protection and equal benefit of the law without discrimination, it automatically includes the expectation of being treated fairly, and impartially,

But the framers of the Charter expanded on this premise even further. The Charter states that the citing of certain rights and freedoms (specifically named) “shall NOT be construed as denying the existence of any other rights or freedoms that exist in Canada.” These other rights and freedoms include those liberties — life, liberty and security — that are endowed by our Creator. These are oOur natural rights — that are not bestowed upon us by the institutions of men. In this context, the people of Canada are to be protected from the wiles of government overreach; faulty laws; unscrutinized absolutes and declarations - “orders”; parliamentary attempts to remove a citizen’s right to due process; and likewise, equal protection under the highest law of the land.

More importantly, we need to understand that the Charter did not intend for elected governments to act as they please, but rather, to ensure (by virtue of the oath taken) that when governments abuse their authority, the people have a legitimate recourse. Specifically, Section 32 of the Charter tells us that (a) the Charter applies to the Parliament and government of Canada in respect of ALL matters within the authority of Parliament including all matters relating to the Yukon Territory and Northwest Territories; and (b) to the legislature and government of each province in respect of all matters within the authority of the legislature of each province.

The Government’s role then is to secure our rights and freedoms against our enemies. This does not translate into elected officials on both sides of Parliament condoning government attempts to pick and choose who (or what) becomes our enemy. By extension, there needs to be a clear understanding that governments cannot do in law what this same government will not allow its citizens to do. The law applies equally to government as it does its citizens. We do not live under a Pharaoh. Neither should the electorate face unrelenting condemnation or persecution for criticizing the absolute power and oppression that we are seeing on the horizon.

At the same time, we do not need new agencies and power-demanding roles created in the name of safety and security. I’m old enough to remember when the Charter was first entrenched in 1982. Lawmakers in all jurisdictions were given three years to bring all laws into conformity and alignment with the Charter. Since then, we have witnessed a proliferation of laws enacted in the name of safety and security— that clearly violate our rights and freedoms — and the opposition

that we elected to stand in the gap for us — to fight for what is right and just and true, including our God-given rights that are not planetary or global but those inherent within a properly instituted nation, remain silent.

One last point. When Members of Parliament made an oath (a solemn affirmation) of allegiance to the Sovereign and to the institutions the Queen represents (including the concept of democracy), did that allegiance not act as a promise to the people — a binding contract under contract law — that could, in Biblical terms be equated to a covenant? And in pledging allegiance by placing your hand on the Bible, does that not further secure and sanctify your personal covenant with God?

You see, prior to Covid-19, citizens at least had some opportunity to know when government was acting in secret, because to some extent, we had an opposition willing to stand in Parliament against the governing authorities when the latter chose to infringe on the rights and freedoms of people. But now?!?! Our conservative values — the very morals that coincide with loving our neighbour — are being replaced by the elimination of any right to conscientious objection and belief.

I could go on and on but for now, know that as a candidate running as an independent in Bruce-Grey-Owen Sound (with the intent of becoming the first candidate for the Jesus-dependent Party of Canada - currently being processed by Elections Canada) please pray that I have the continued courage to stand in the windy places for our electoral district and country.

Our children and grandchildren are counting on it!
